General Terms and Conditions of Use

The use of the Sneakers Alert website implies the full and complete acceptance of the following General Terms and Conditions of Use. These conditions of use may be modified or supplemented at any time, so users of the Sneakers Alert website are invited to consult them regularly.

This website is normally accessible to users at all times. However, an interruption for technical maintenance may be decided by Sneakers Alert, which will then make every effort to communicate the dates and times of the intervention to users in advance.

The Sneakers Alert website is regularly updated. Similarly, the legal notices may be modified at any time: nevertheless, they are binding on the user who is invited to refer to them as often as possible in order to be informed of any changes.

Use of the Application

The Sneakers Alert Application is intended to inform you about sneaker news, upcoming releases and the latest trends in sneakers.

Access to the Application is reserved for adults who have legal capacity. By downloading and using the Application, you declare that you are of legal age and have the legal capacity to enter into a contract. The Application is accessible for free from the App Store and Google Play. Access to the application requires an internet connection. Connection fees are the responsibility of the user.

The Application is intended for personal and non-commercial use. You agree not to use the Application for illegal purposes or purposes that could infringe the rights of Sneakers Alert or third parties. You are responsible for the confidentiality of your user account and password. You agree not to disclose your password to third parties and to inform Sneakers Alert immediately of any unauthorized use of your user account. The use of the application may require the creation of a user account. You agree to provide accurate and up-to-date information when creating your user account.

Sneakers Alert reserves the right to suspend or terminate your user account in case of non-compliance with these General Terms and Conditions of Use.

Intellectual Property

The Sneakers Alert website and its content (texts, images, videos, etc.) are protected by the laws on intellectual property in force in Andorra. Any reproduction, modification, distribution or exploitation of this content without prior written authorization from GAST is strictly prohibited.

The trademarks, logos and trade names present on the Sneakers Alert website are the property of GAST or their respective owners. Any use of these elements without prior written authorization is prohibited.

Limitation of Liability

GAST cannot be held liable for direct or indirect damages caused to the user’s equipment, when accessing the Sneakers Alert website, and resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or incompatibility.

GAST cannot be held liable for indirect damages (such as, for example, loss of market or loss of opportunity) resulting from the use of the Sneakers Alert website.
Interactive spaces (possibility to ask questions in the contact space) are available to users. GAST reserves the right to delete, without prior notice, any content deposited in this space that would contravene the applicable legislation in Andorra, in particular the provisions relating to data protection. Where appropriate, GAST also reserves the right to engage the civil and/or criminal liability of the user, in particular in the event of a message of a racist, insulting, defamatory, or pornographic nature, whatever the medium used (text, photograph, etc.).

Personal Data Management

In Andorra, personal data is protected in particular by law no. 78-87 of 6 January 1978, law no. 2004-801 of 6 August 2004, article L. 226-13 of the Penal Code and the European Directive of 24 October 1995.

When using the Sneakers Alert website, the following information may be collected: the URL of the links through which the user accessed the Sneakers Alert website, the user’s internet service provider, and the user’s internet protocol (IP) address.

In any case, GAST only collects personal information about the user for the purpose of providing certain services offered by the Sneakers Alert website. The user provides this information knowingly, especially when entering it themselves. The user of the Sneakers Alert website is informed of whether or not they are required to provide this information.

In accordance with articles 38 and following of law n° 78-17 of January 6, 1978, relating to information technology, files, and civil liberties, any user has the right to access, rectify, and oppose personal data concerning them by making a written and signed request, accompanied by a copy of an identification document with the signature of the document holder, and specifying the address to which the response should be sent.

No personal information of the user of the Sneakers Alert website is published without their knowledge, exchanged, transferred, sold, or given to any third party. Only in the event of the acquisition of GAST and its rights would such information be transmitted to the potential acquirer, who would be bound by the same obligation to preserve and modify data regarding the user of the Sneakers Alert website.

The Sneakers Alert website is not declared to the CNIL because it does not collect personal information. The databases are protected by the provisions of the law of July 1, 1998, transposing the directive 96/9 of March 11, 1996, relating to the legal protection of databases.

Hypertext links and cookies

The Sneakers Alert website contains a number of hypertext links to other websites, set up with GAST’s authorization. However, GAST does not have the ability to verify the content of the visited sites and therefore assumes no responsibility for them.

Browsing the Sneakers Alert website may result in the installation of cookie(s) on the user’s computer. A cookie is a small file that does not allow the identification of the user but records information about a computer’s browsing on a site.

The data obtained is intended to facilitate further navigation on the site and is also intended to allow various frequency measurements.

Refusal to install a cookie may result in the inability to access certain services. However, the user can configure their computer as follows to refuse cookie installation:

In Internet Explorer: click on the tool tab (gear-shaped icon in the top right corner) / internet options. Click on Privacy and choose Block All Cookies. Click OK to validate.

In Firefox: at the top of the browser window, click on the Firefox button, then go to the Options tab. Click on the Privacy tab. Set the retention rules to use custom settings for the history. Finally, uncheck it to disable cookies.

In Safari: click on the menu icon (symbolized by a gear) in the upper right corner of the browser. Select Settings. Click on Show advanced settings. In the “Privacy” section, click on Content Settings. In the “Cookies” section, you can block cookies.

In Chrome: click on the menu icon (symbolized by three horizontal lines) in the upper right corner of the browser. Select Settings. Click on Show advanced settings. In the “Privacy” section, click on Preferences. In the “Privacy” tab, you can block cookies.

Applicable law and competent jurisdiction

These legal notices are governed by Andorran law. Any dispute relating to the application of Sneakers Alert will be subject to the exclusive jurisdiction of the Andorran courts.
